does anyone have any info. on the following.
I have read the will of lachlan mctavish dunardry (died1796)and noted there is NO mention of his recently awarded arms/titles as dunardry. I found this very strange as he takes the effort to detail his linen and trinkets .. but NO instruction for passage of his titles or any mention of his titles.
It has been suggested that lachlans sons and heirs "disponed" these titles to Simon Mactavish of Garthbeg. The lack of mention of ANY titles in Lachlans will suggests to me lachlan had already passed these to Simon ...
Now when I look at the will of Simon mactavish in 1804... I see VERY clear instruction as to the heirship of his Dunardry titles and land. Simon clearly makes definition between the land of Dunardry and the titles of Dunardry....even stating clearly that the land of Dunardry and the Dunardry arms were to remain within his family FOREVER.
Some people have suggested Simon only got a land title to Dunardry and NOT the arms... Well I suggest they read his will in detail. Simon had no doubt he was titled Dunardry, and neither did his sons who both unforunately died without issue.
Simon mactavish will of 1804 is clear that his land of Dunardry was never to leave his family or descendants forever.Simon also makes clear instruction that if the dunardry land was inherited by a male not of the mactavish name the titles of dunardry were to be passed to the next male of the mactavish name. In any event we know it is illegal to buy any arms that prove lineage ..so the suggestion these titles came with the land purchase is rediculous. Simon Mactavish must have been using the title of "dunardry" with aceptance from lachlans family , or approval from the Mactavish clan as to use such title without permission is illegal. NO record of ANY objection from Lachlans heirs or clan Mactavish with regard to simon mactavish being titled "dunardry"shows Simon was "disponed" these titles as suggested...Many people have made reference to the documents that exist that prove "simon was disponed the titles of "dunardry" in 1797.......and if this IS the case...then Simon Mactavish was indeed the LAST chief of the Mactavish clan from 1797 until his death in 1804. Then it is documented that Simons 2 sons inherited the dunardry titles....After Simon Mact death in 1804 Simons eldest son William became titled "dunardry" from this date until his early death in 1818...then the titles were passed to his younger brother Simon who duly became Simon Mactavish of Dunardry from 1818. It is then suggested that Simon (jnr) had little interest in the title and offered it back to lachlans heir Dugald. It is stated that Dugald refused and the fate of these titles has remained unknown.
We know the subsequent owners of Dunardry.. didnt become titled "dunardry" simply due to their purchase of the lands .
Simons will is clear that his titles of Dunardry were NEVER to leave his family or descendants FOREVER.
Someone must have made legal application to amend Simons will to..
1..remove the dunardry titles from his family line.
2..sell Dunardry...
It would appear that without a legal application to amend Simons will the sale of Dunadry wasnt legal nor binding and the removal of the Dunardry titles was also illegal . It also appears clearly evident that simon mactavish was in fact the last chief of the mactavish clan inherited from lachaln or lachlans sons.
